The promise of a unilateral undertaking and submission of amended plans following the refusal of planning permission led to the withdrawal of the reasons for refusal relating to affordable housing, parking, servicing and highway matters.

Copies of the amended plans were sent to the Save Tadworth Action Group before the Inquiry. I shall determine the appeal on the basis of these amended drawings as I do not consider that to do so would prejudice the interests of any party. For the avoidance of doubt, the plans considered by me in the determination of the appeal are set out at the end of this Decision.

Planning Policy

The development plan for the area includes the Surrey Structure Plan (adopted 4 December 2004) and the Reigate and Banstead Borough Local Plan 2005. Policy Ho 20 encourages the provision of new dwellings for the elderly in urban areas provided they are suitably located and would not detract from the character and appearance of the area. Proposals should also comply with Policies Ho 9 and Ho 13. Policy Ho 9 requires development to, amongst other things, make the best use of land, retain trees and respect the amenities of adjoining properties. These aims are reinforced by Policy Ho 13 and Pc 4 of the Local Plan and Policies SE4 and SE9 of the Structure Plan.
